1. Agreement

By installing Green Claims Checker, you agree to these Terms of Service. This is an agreement between you and BrandUp Factory GmbH. If you do not agree, do not install or use the app.

2. Service Description

Green Claims Checker checks the texts of a Shopify store for environmental claims that may be banned or risky under Directive (EU) 2024/825:

• Scans of products, collections, pages and blog posts

• Findings with explanation and suggested wording

• Saving new wording to Shopify, with undo

• Evidence manager with expiry dates

• Monitoring, daily scan and weekly digest

• AI assessment and rewrites

• PDF audit report, CSV export, custom rules

• Claim explanation block and Green Claims Seal

3. No Legal Advice, Your Responsibility

The app points out wording that may be risky and explains the rule behind it. It does not provide legal advice and does not guarantee compliance with Directive (EU) 2024/825, national law or any other rules. It can miss claims and can flag wording that is fine. You are responsible for your texts and environmental claims, for the accuracy of your evidence, for reviewing suggested and AI-generated wording before saving it, and for checking which obligations apply to your business. Findings, scores and suggestions are aids, not a legal review.

4. Green Claims Seal

The seal states only that a scan with the app found no open banned or needs-evidence findings on the date shown. It is not a sustainability label or a certification, does not confirm that your claims are true or lawful, and is withdrawn automatically when its requirements are no longer met. Do not present it as anything else.

5. Pricing & Billing

Plans, billed monthly or yearly through Shopify:

Free — 50 content items, manual scans, fix in app, evidence manager

Starter $15/mo — 500 content items, automatic monitoring and daily scan, weekly digest, CSV export

Pro $29/mo — Unlimited content items, AI assessment and rewrites (300 per month), PDF audit report, custom rules, claim explanation block

Premium $50/mo — Everything in Pro, Green Claims Seal, 1,000 AI assessments per month

Yearly plans cost ten monthly payments. Paid plans include a 14-day free trial. All charges are billed through Shopify and appear on your regular Shopify invoice. You can change or cancel your plan on Shopify’s plan page at any time. Refunds follow Shopify’s billing rules. Prices may change with 30 days’ notice.

6. Third-Party Services

The app relies on Shopify and, for AI assessments and rewrites, on Anthropic’s Claude API. Your use of Shopify is additionally subject to its terms. We are not responsible for the availability of these services or for changes to them.

7. Your Obligations

You agree to:

• Enter accurate evidence and only claim what you can back up

• Not include personal data in texts, evidence notes or instructions you send to the AI

• Comply with Shopify’s Terms of Service

• Not use the app for illegal or deceptive purposes

• Not reverse engineer or redistribute the app

8. Availability and Uninstalling

We aim for high availability but do not guarantee uninterrupted access. Your Shopify texts stay unchanged when you uninstall the app; your data in the app is deleted as described in the Privacy Policy. Export what you need before uninstalling.

9. Limitation of Liability

We are not liable for indirect, incidental, or consequential damages including loss of profits, data, or goodwill, or for warning letters, fines or claims resulting from your texts, whether or not the app flagged them. Our total liability shall not exceed the amount paid in the 12 months preceding the claim. Mandatory statutory liability remains unaffected.

10. Intellectual Property

The app, its rule set and its features are owned by BrandUp Factory GmbH. Your texts and evidence remain yours.

11. Termination

We may suspend or terminate access for violations of these terms. You may terminate at any time by uninstalling the app from Shopify.

12. Governing Law

These terms are governed by German law. Disputes are subject to the exclusive jurisdiction of the courts in Hamburg, Germany, where legally permitted.

13. Changes

We may modify these terms. Changes are posted here with an updated date.
