1. Agreement

By installing Index AI, you agree to these Terms of Service. This is a legal agreement between you and BrandUp Factory. If you do not agree, do not install or use the app.

2. Service Description

Index AI provides AI-powered tools for Shopify stores:

• AI product descriptions

• SEO optimization

• Content translation

• Bulk editing

• Analytics integration

• Performance insights

3. Pricing & Billing

Available plans billed monthly through Shopify:

Free — 5 products per month, basic features

Starter €9.99/mo — 25 products per month

Professional €24.99/mo — 100 products per month

Enterprise €74.99/mo — Unlimited products

All paid plans are billed through Shopify and appear on your regular invoice. You may cancel anytime through Shopify admin. Refunds follow Shopify's refund policy.

4. AI-Generated Content

No warranty — AI content is provided "as is" without guarantees of accuracy or completeness.

Your responsibility — Review and approve all generated content before publishing.

No liability — We are not liable for consequences arising from AI-generated content.

5. Your Obligations

You agree to:

• Provide accurate store information

• Review content before publishing

• Comply with Shopify's Terms of Service

• Not use the app for illegal or deceptive purposes

• Not reverse engineer or redistribute the app

6. Availability

We strive for high availability but do not guarantee uninterrupted access. Maintenance, updates, or external factors may cause temporary unavailability. We are not liable for losses resulting from service interruptions.

7. Limitation of Liability

We are not liable for indirect, incidental, or consequential damages including loss of profits, data, or goodwill. Our total liability shall not exceed the amount paid in the 12 months preceding the claim. The app is provided "as is" without warranties of any kind.

8. Intellectual Property

The app and its features are owned by BrandUp Factory and protected by intellectual property laws. AI-generated content created for your store becomes your property upon generation.

9. Termination

We may suspend or terminate access for terms violations or at our discretion. You may terminate by uninstalling from Shopify. Upon termination, your data is deleted per our Privacy Policy.

10. Governing Law

These terms are governed by German law. Disputes are subject to the exclusive jurisdiction of courts in Hamburg, Germany.

11. Changes

We may modify these terms at any time. Changes will be posted here with an updated date. Continued use after changes constitutes acceptance.
