1. Agreement

By installing Digital Product Passport, you agree to these Terms of Service. This is an agreement between you and BrandUp Factory GmbH. If you do not agree, do not install or use the app.

2. Service Description

Digital Product Passport lets Shopify merchants create, publish and manage digital product passports for their products, with a focus on textiles:

• Passport editor with completeness check

• Public passport page and JSON on the shop domain

• QR codes and GS1 Digital Link

• Version history with SHA-256 checksum

• French environmental cost via Ecobalyse

• Warnings for generic environmental claims

• CSV import and export

• Theme block for product pages

3. No Legal Advice, Your Responsibility

The app is a tool for recording and publishing product information. It does not provide legal advice and does not guarantee compliance with the Ecodesign Regulation (EU) 2024/1781, French law or any other rules. You are responsible for the accuracy and completeness of the data you enter and publish, for any environmental claims you make, and for checking which obligations apply to your business. Warnings and checks in the app are aids, not a legal review.

4. Pricing & Billing

Plans, billed monthly or yearly through Shopify:

Free — Up to 10 passports

Starter $9/mo — Up to 100 passports

Pro $29/mo — Up to 500 passports, CSV import, GS1 Digital Link, French environmental cost, no BrandUp branding

Unlimited $79/mo — Unlimited passports, everything in Pro

Yearly plans cost ten monthly payments. Paid plans include a 14-day free trial. All charges are billed through Shopify and appear on your regular Shopify invoice. You can change or cancel your plan in the app at any time. Refunds follow Shopify’s billing rules. Prices may change with 30 days’ notice.

5. Third-Party Services

The app relies on Shopify and, for the French environmental cost, on the Ecobalyse service of the French government. Your use of these services is additionally subject to their terms. We are not responsible for their availability, results or changes, for example a new version of the Ecobalyse method.

6. Your Obligations

You agree to:

• Enter accurate product and company information

• Publish the French environmental cost only after declaring it on the official portal

• Comply with Shopify’s Terms of Service

• Not use the app for illegal or deceptive purposes

• Not reverse engineer or redistribute the app

7. Availability and Uninstalling

We aim for high availability but do not guarantee uninterrupted access. Published passport pages are served while the app is installed; when you uninstall the app they go offline, and your data is deleted as described in the Privacy Policy. Export your passport data as CSV before uninstalling if you need it. Do not change the passport URLs once QR codes are printed.

8. Limitation of Liability

We are not liable for indirect, incidental, or consequential damages including loss of profits, data, or goodwill, or for fines or claims resulting from incorrect or incomplete passport data. Our total liability shall not exceed the amount paid in the 12 months preceding the claim. Mandatory statutory liability remains unaffected.

9. Intellectual Property

The app and its features are owned by BrandUp Factory GmbH. The product and company data you enter remain yours.

10. Termination

We may suspend or terminate access for violations of these terms. You may terminate at any time by uninstalling the app from Shopify.

11. Governing Law

These terms are governed by German law. Disputes are subject to the exclusive jurisdiction of the courts in Hamburg, Germany, where legally permitted.

12. Changes

We may modify these terms. Changes are posted here with an updated date.
